It is worth noting that Dustin Marks was never caught cheating, unlike Charles Oakley. Having on hand records from surveillance cameras, the basketball player was initially wanted to be tried as a felony with a prison sentence of up to 6 years. But then everything turned out to be a minor violation. That's why he won't go to jail.
